A comprehensive service for obtaining the Nazir deed – through systematic steps and authorized witnesses By: Alaa Abu Anas Thursday, 16 Rabi al-Thani 1447 AH, corresponding to October 9, 2025 AD The Nazir deed is considered one of the most important legal documents related to managing endowments in the Kingdom of Saudi Arabia. It is the document that officially appoints the Nazir (custodian) of the endowment, granting him the legal authority to manage its affairs and carry out its religious and administrative objectives, thereby preserving the assets, increasing their yield, and disbursing it in charitable and benevolent causes as defined by the donor. The procedures for obtaining the Nazir deed typically begin with submitting a formal application to the competent court, in which the applicant provides details about the endowment, the original deed, the names of the donors, and the party they wish to appoint. The application must be accompanied by evidence of the applicant's relationship or qualification regarding the endowment, along with the presence of witnesses and reconcilers to legally verify the matter before the judge. In these procedures, accuracy in recording the endowment's details, precisely identifying the Nazir, and confirming his eligibility and capability to manage the endowment in line with its intended purposes are essential. This step ensures the proper continuity of the endowment and prevents any actions that might violate the donor’s intentions or the beneficiaries' rights. Judicial and endowment authorities strive to facilitate these procedures through electronic platforms such as the "Najiz" platform and the Endowments Authority, contributing to faster issuance of deeds and enhancing transparency and reliability in endowment transactions. Closing Message: Obtaining the Nazir deed is not merely a procedural requirement; it is a religious act and a great trust. The Nazir stands in place of the donor in fulfilling the endowment's purpose and bears the responsibility of managing property dedicated to Allah. The Prophet Muhammad ﷺ said: "When a person dies, their deeds are cut off except from three: ongoing charity, beneficial knowledge, or a righteous child who prays for them." Endowment is among the greatest forms of ongoing charity, and the trustworthy Nazir shares in the reward of the donor as long as he acts sincerely, justly, and faithfully, striving to preserve the endowment, increase its yield, and spend it in ways that please Allah and benefit people.
